TERMS AND CONDITIONS


These terms apply to all orders submitted through Framhus's online store located at framhus.com (and hereafter referred to as the “webshop”), and covers all purchase agreements between you, the customer, and Framhus AS (hereafter called Framhus). 

Eligibility

You must be at least 18 years old to use this Service. By using the Service, you represent and warrant that you meet this eligibility requirement.

Products

We offer clothing and accessories for sale. All descriptions of products, pricing, and availability are subject to change at any time without notice. We reserve the right to modify or discontinue the product (or any part of it) at any time without notice.

Orders and Payment

  • Order Acceptance: All orders are subject to acceptance by us. We reserve the right to refuse or cancel any order for any reason, including availability, errors in product descriptions, or pricing errors.
  • Pricing: Prices displayed on our website are in Currency NOK and include VAT unless otherwise stated. Shipping costs and other charges will be added at checkout.
  • Payment Methods: We accept the following payment methods: PayPal and Klarna. All payments must be made in full before the dispatch of goods.

Right of Withdrawal

Unless the agreement is exempt from the right of withdrawal, the buyer may cancel the purchase of the item in accordance with the Right of Withdrawal Act.

The buyer must notify the seller by email to: info@framhus.com of the use of the right of withdrawal within 14 days from the day the order was received. 

When exercising the right of withdrawal, the item must be returned to the seller without undue delay and no later than 14 days from the notice of exercising the right of withdrawal. The buyer covers the direct costs of returning the item unless otherwise agreed or the seller has failed to inform that the buyer should cover the return costs. The seller cannot impose any fees for the buyer’s use of the right of withdrawal.

The seller is obliged to refund the purchase amount to the buyer without undue delay and no later than 14 days from the seller receiving notice of the buyer’s decision to exercise the right of withdrawal. The seller has the right to withhold the refund until the items are received from the buyer, or until the buyer has provided proof that the items have been returned.

Defects in the Item - Buyer's Rights and Complaint Deadline

If there is a defect in the item, the buyer must notify the seller within a reasonable time after it was discovered or should have been discovered, indicating that they intend to invoke the defect. The buyer has always complained in a timely manner if it occurs within 2 months from when the defect was discovered or should have been discovered. Complaints can be made no later than two years after the buyer took possession of the item. If the item or parts of it are intended to last significantly longer than two years, the complaint period is five years.

If the item has a defect and this is not due to the buyer or circumstances on the buyer's side, the buyer can, according to the rules in Chapter 6 of the Consumer Purchases Act, depending on the circumstances, withhold the purchase amount, choose between repair and replacement, demand a price reduction, demand the agreement terminated, and/or demand compensation from the seller.

Complaints to the seller should be made in writing.

Limitation of Liability

To the maximum extent permitted by applicable law, Framhus and its affiliates shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising out of your use of the Service or the purchase of any products.

Governing Law

These Terms are governed by and construed in accordance with the laws of Norway. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts located in Oslo, Norway.

Changes to These Terms

We reserve the right to update or modify these Terms at any time without prior notice. Your continued use of the Service following any changes constitutes your acceptance of the revised Terms.

Dispute Resolution

Complaints should be directed to the seller within a reasonable time. The parties shall attempt to resolve any disputes amicably. If this does not succeed, the buyer can contact the Consumer Authority for mediation. The Consumer Authority is available by phone at 23 400 600 or www.forbrukertilsynet.no.

The European Commission's online dispute resolution platform can also be used if you wish to file a complaint. This is particularly relevant if you are a consumer residing in another EU country. The complaint can be filed here: http://ec.europa.eu/odr.
